How are the penalties for Abuses against chastity modified if the victim is a relative of a person under the offender’s custody?
The penalties are mitigated if the person solicited is the wife, daughter, sister, or a relative within the same degree by affinity of any person held in the custody of the warden or officer (Article 245, Revised Penal Code). When this specific relationship exists, the prescribed penalties are reduced to prision correccional in its minimum and medium periods. Additionally, the offender shall still suffer temporary special disqualification. The law recognizes the special vulnerability and gravity when the victim is a relative of the detained person.
