How are physicians or midwives penalized if they cause or assist in causing an abortion?
Physicians or midwives who take advantage of their scientific knowledge or skill to cause an abortion or assist in causing one shall be penalized severely (Article 259, Revised Penal Code). The penalties provided in Article 256 for intentional abortion shall be imposed, specifically in their maximum period. This increased severity reflects the offender’s abuse of a position of trust and specialized professional skill. The penalties depend on whether violence was used or if the woman consented.
