Does the Data Privacy Act apply to personal data of foreigners collected abroad but processed in the Philippines?

The Act establishes a specific exemption for personal information originally collected from residents of foreign jurisdictions. If this data is collected in accordance with the strict laws of those foreign jurisdictions and is merely being processed in the Philippines, it generally falls outside the Act’s primary scope. However, the entities processing this data within the country remain absolutely subject to the strict requirements of implementing security measures for data protection. The nuances of this specific extraterritorial scenario are detailed in Section 4 Data Privacy Act. “This Act does not apply to the following… (g) Personal information originally collected from residents of foreign jurisdictions in accordance with the laws of those foreign jurisdictions, including any applicable data privacy laws, which is being processed in the Philippines.” 22-May-26
