Does martial law suspend the operation of the Constitution?
A state of martial law does not mean the Constitution is set aside. The supreme law of the land continues to operate fully even during such times. It also does not automatically shut down the civil courts or legislative bodies. Military courts cannot take over jurisdiction if the regular civil courts are still functioning.
