Can the Ombudsman directly remove or suspend a public official found at fault?
The Ombudsman does not execute the removal directly but can direct the concerned officer to take appropriate action. The Ombudsman is empowered to recommend the removal, suspension, demotion, fine, censure, or prosecution of a public official at fault. Crucially, the Ombudsman also has the power to ensure compliance with these recommendations. This disciplinary recommendation authority is outlined in Article XI, Section 13, 1987 Philippine Constitution. “(3) Direct the officer concerned to take appropriate action against a public official or employee at fault, and recommend his removal, suspension, demotion, fine, censure, or prosecution, and ensure compliance therewith.” 06-Mar-26About Nicolas and De Vega Law Offices
