Can medical professionals prepare patented medicines for individual prescriptions?

  Medical professionals or pharmacists are permitted to prepare medicines for individual cases in a pharmacy. This act must be done in accordance with a valid medical prescription. Such acts concerning the medicine so prepared do not constitute infringement. This healthcare-related exception is established in Section 72 Intellectual Property Code of the Philippines.   “72.5. Where the act consists of the preparation for individual cases, in a pharmacy or by a medical professional, of a medicine in accordance with a medical prescription or acts concerning the medicine so prepared;”   January 3, 2026
