Can an innocent infringer engaged solely in printing be subject to a claim for damages?

  An innocent infringer who is exclusively in the business of printing materials for others is protected from financial damage claims. The owner of the right being infringed is only entitled to an injunction against that printer to stop future infringing acts. Section 159.2 Intellectual Property Code of the Philippines limits liability in this way because the printer may not be aware of the trademark status. This protects service-based businesses from being penalized for the illegal actions of their customers. “Where an infringer who is engaged solely in the business of printing… is an innocent infringer, the owner… shall be entitled as against such infringer only to an injunction”   January 7, 2026
