Can a worker directly file a court case for breach of an apprenticeship agreement?

A worker or any party involved in an apprenticeship agreement cannot immediately bypass administrative procedures to file a civil lawsuit. The law mandates strict adherence to a specific procedural doctrine before resorting to formal judicial action. No person shall institute any action for the enforcement of the agreement or claim damages for its breach without completing prior steps. They must first exhaust all available administrative remedies as required by Article 67 Labor Code of the Philippines. “ART. 67. Exhaustion of Administrative Remedies. – No person shall institute any action for the enforcement of any apprenticeship agreement or damages for breach of any such agreement, unless he has exhausted all available administrative remedies.” 31-May-26
