Can a person remarry immediately if their previous marriage was void?
A person cannot simply assume their previous marriage is void and unilaterally decide to quickly remarry. The absolute nullity of a previous marriage must be formally and legally established first in court. This necessary procedural safeguard is mandated by Article 40 Family Code of the Philippines. Therefore, a final judgment from a competent court declaring the previous marriage void is an absolute prerequisite. “Art. 40.
