Can a foreign national sue for patent infringement in the Philippines?

  Any foreign national or entity whose patent rights are granted or assigned under the Act may bring an action. They do not need to be engaged in business within the Philippines to file the suit. This applies even if they are not licensed to do business under existing laws. This right of foreign nationals is stated in Section 77 Intellectual Property Code of the Philippines.   “SEC. 77. Infringement Action by a Foreign National. – Any foreign national or juridical entity… to which a patent has been granted or assigned… may bring an action for infringement of patent…”   January 3, 2026
