Are the property relations between spouses during marriage subject to stipulation?

Generally, the nature, consequences, and incidents of marriage are strictly governed by law and are not subject to stipulation. However, the law provides a highly specific exception regarding the property relations of the spouses. Couples are allowed to properly execute marriage settlements to fix their property relations during the marriage. This exception must be completely within the limits provided by law as stated in Article 1 Family Code of the Philippines. “Art. 1. Marriage is a special contract of permanent union between a man and a woman entered into in accordance with law for the establishment of conjugal and family life. It is the foundation of the family and an inviolable social institution whose nature, consequences, and incidents are governed by law and not subject to stipulation, except that marriage settlements may fix the property relations during the marriage within the limits provided by this Code.” 31-Jul-26
