Within what period must an individual file a complaint for an unfair labor practice before the appropriate agency?
The law provides a strict prescriptive period for filing complaints concerning unfair labor practices to ensure timely resolution. Any unfair labor practice arising from Book V of the Code must be filed within one year from the date such practice accrued. If the aggrieved party fails to file the complaint within this one-year period, they lose their right to do so entirely. The claim shall be forever barred by the statute of limitations. This prescriptive rule is mandated in Article 305 Labor Code of the Philippines. “All unfair labor practice arising from Book V shall be filed with the appropriate agency within one (1) year from accrual of such unfair labor practice; otherwise, they shall be forever barred.” 02-Jun-26About Nicolas and De Vega Law Offices
