Who will inherit if the husband died leaving behind his wife and parents?
If the husband died without a will, leaving behind his wife and his parents, then the wife shall inherit one-half while the parents will get one-half of the estate. Thus, Article 997 of the Civil Code states:
“ARTICLE 997. When the widow or widower survives with legitimate parents or ascendants, the surviving spouse shall be entitled to one-half of the estate, and the legitimate parents or ascendants to the other half. ”
