Who is treated as the “inventor” for purposes of the non‑prejudicial disclosure rule?

    For the non‑prejudicial disclosure rule, the term “inventor” has an expanded meaning. Section 25.2, Intellectual Property Code of the Philippines, provides that “inventor” also means any person who, at the filing date of the application, had the right to the patent. This recognizes that rights to a patent can be assigned or transferred before the filing date. Thus, disclosures made by such right‑holders can also fall within the twelve‑month grace period and avoid prejudicing novelty.   20-Dec-25
