Who has jurisdiction over the civil aspects of unfair labor practice cases?

The civil dimensions of unfair labor practice cases are strictly adjudicated at the administrative level. Jurisdiction over claims for actual, moral, and exemplary damages belongs exclusively to the Labor Arbiters. They also hold the authority to grant attorney’s fees and other affirmative relief arising from these disputes. This jurisdictional mandate is clearly granted under Article 258 Labor Code of the Philippines, ensuring specialized resolution. “Subject to the exercise by the President or by the Secretary of Labor and Employment of the powers vested in them… the civil aspects of all cases involving unfair labor practices, which may include claims for actual, moral, exemplary and other forms of damages, attorney’s fees and other affirmative relief, shall be under the jurisdiction of the Labor Arbiters.” 01-Jun-26
