When is the requirement to obtain a license on reasonable commercial terms waived?

  This requirement is waived in situations of national emergency or extreme urgency. It is also not necessary for cases involving public non-commercial use of the invention. Additionally, it does not apply when the demand for medicines is not being met adequately. These waivers are detailed in Section 95 Intellectual Property Code of the Philippines.   “95.2. The requirement under Subsection 95.1 shall not apply in any of the following cases… (b) In situations of national emergency… (c) In cases of public non-commercial use;”   January 3, 2026
