When is the penalty for Rape elevated to reclusion perpetua to death based on the means used or the resulting harm to the victim?

The penalty for Rape is elevated to reclusion perpetua to death when the crime is committed with the use of a deadly weapon or by two or more persons (Article 266-B, Revised Penal Code). Additionally, if, by reason or on the occasion of the rape, the victim has become permanently insane, the penalty is likewise reclusion perpetua to death. The gravity of the offense increases significantly due to the use of dangerous instruments, collective action, or severe psychological injury.
