When is the maximum criminal penalty mandatory?

  The maximum penalty for the respective offense must be imposed if it involves circumventing technological measures. It also applies to the unauthorized removal or alteration of electronic rights management information. Furthermore, distributing or broadcasting works known to have altered rights data triggers this maximum. This requirement is stated in Section 217.2 Intellectual Property Code of the Philippines.   “Provided, That the respective maximum penalty… shall be imposed when the infringement is committed by: (a) The circumvention of effective technological measures; (b) The removal or alteration of any electronic rights management information… (c) The distribution… without authority…”   January 8, 2026
