When is a name or designation prohibited from being used as a trade name?
A name cannot be used as a trade name if its nature or use is contrary to public order or morals. It is also prohibited if the name is likely to deceive trade circles or the public about the nature of the enterprise. Section 165.1 Intellectual Property Code of the Philippines sets these standards to protect societal values and prevent consumer confusion.
