When can the privacy of communication and correspondence be violated?
The privacy of communication and correspondence is generally considered inviolable under the law. However, this privacy can be set aside upon a lawful order issued by a court. It may also be bypassed when public safety or order requires such an intervention as prescribed by law. According to Article III Section 3 1987 Philippine Constitution, any evidence obtained in violation of this right is inadmissible in any proceeding. “SECTION 3. (1) The privacy of communication and correspondence shall be inviolable except upon lawful order of the court, or when public safety or order requires otherwise as prescribed by law. (2) Any evidence obtained in violation of this or the preceding section shall be inadmissible for any purpose in any proceeding.” 28-Jan-26About Nicolas and De Vega Law Offices
