When can patent infringement lead to criminal liability?

  Criminal liability arises if the infringement is repeated after a final judgment has been rendered against the infringer. The offenders can suffer imprisonment for six months to three years. They may also be fined between one hundred thousand and three hundred thousand pesos. This criminal action is authorized by Section 84 Intellectual Property Code of the Philippines.   “SEC. 84. Criminal Action for Repetition of Infringement. – If infringement is repeated by the infringer… after finality of the judgment… the offenders shall… be criminally liable therefor…”   January 3, 2026
