When and how is a Philippine patent application published?
Patent applications are generally published after 18 months. Section 44.1, Intellectual Property Code of the Philippines, states that after eighteen months from the filing or priority date, the application shall be published in the IPO Gazette together with a search document citing prior art. Section 44.2, Intellectual Property Code of the Philippines, allows any interested party to inspect the application documents after publication. Section 44.3 also permits the Director General, with approval of the Secretary of Trade and Industry, to prohibit or restrict publication if it would prejudice national security or interests.
