What restrictions apply to the SEC when publishing findings or information concerning a violation?

The SEC is authorized to investigate and publish its findings, orders, opinions, advisories, or information concerning any alleged violation of the Code or its regulations (SEC. 154, Revised Corporation Code of the Philippines). However, this publication power is explicitly subject to the provisions of Republic Act No. 10173, otherwise known as the “Data Privacy Act of 2012”, and other pertinent laws. The SEC is also mandated to give reasonable notice to and coordinate with the appropriate regulatory agency prior to any such publication if it involves companies under their special regulatory jurisdiction. This ensures that privacy rights and sectoral oversight are respected during the disclosure process.
