What penalties are imposed for Intentional abortion committed without the woman’s consent or only with her consent?
If the intentional abortion is performed without using violence, but the perpetrator acts without the consent of the pregnant woman, the penalty shall be prision mayor (Article 256, Revised Penal Code). However, if the woman herself shall have consented to the intentional abortion, the perpetrator shall suffer the lesser penalty of prision correccional in its medium and maximum periods. The degree of coercion or consent greatly affects the severity of the punishment imposed.
