What must the solemnizing officer do when marrying a couple who cohabited for five years?

The solemnizing officer holds a specific duty when officiating a marriage based on five years of cohabitation. The officer must state under oath that they have properly ascertained the qualifications of both contracting parties. This mandate is required by Article 34 Family Code of the Philippines. Additionally, the officer must confirm that no legal impediment exists to prevent the marriage. “The solemnizing officer shall also state under oath that he ascertained the qualifications of the contracting parties and found no legal impediment to the marriage.” 31-Jul-26
