What kind of evidence may be accepted as proof in the prosecution of Rape under Article 266-A?

The law dictates that any physical overt act manifesting resistance against the act of rape in any degree from the offended party may be accepted as evidence (Article 266-D, Revised Penal Code). Furthermore, evidence that the offended party is so situated as to render them incapable of giving valid consent may also be accepted in the prosecution of the punishable acts. This provision broadens the scope of acceptable evidence, recognizing that physical resistance may not always be present or possible.
