What is the time limit for recovering damages in an infringement case?

  No damages can be recovered for infringement acts committed more than four years before the case was filed. This creates a clear statute of limitations for monetary recovery in patent litigation. It encourages patentees to act promptly when they discover unauthorized use. This limitation period is set by Section 79 Intellectual Property Code of the Philippines.   “SEC. 79. Limitation of Action for Damages. – No damages can be recovered for acts of infringement committed more than four (4) years before the institution of the action for infringement.”   January 3, 2026
