What is the status of children conceived prior to the termination of a subsequent marriage?

The law actively protects the legal status of children born from a valid subsequent marriage that is later terminated. Children conceived before the termination of such a marriage maintain their full legitimate status under the law. This highly protective measure is guaranteed by Article 43 Family Code of the Philippines. Consequently, issues regarding their custody and support are simply to be decided by the court in proper proceedings. “1. The children of the subsequent marriage conceived prior to its termination shall be considered legitimate, and their custody and support in case of dispute shall be decided by the court in a proper proceeding;” 31-Jul-26
