What is the status of a child if the marriage was declared void?
If the marriage has been declared void, then the children shall be considered as illegitimate from the time they were conceived. Art. 165 of the Family Code states that children conceived and born outside a valid marriage are illegitimate, unless otherwise provided by the Family Code. The exception to this rule is if the marriage was declared void due to psychological incapacity under Art. 36 of the Family Code and when the marriage was declared void under Art. 53 of the Family Code.
