What is the compulsory retirement age specifically set for underground mine workers?
The law recognizes the extreme physical demands and hazards associated with underground mining. Consequently, it sets a significantly lower retirement age for these specific workers compared to regular employees,. An underground mine worker is compulsorily retired upon reaching the age of sixty years. They may optionally retire as early as fifty years old, provided they have served at least five years as an underground mine worker. This special retirement provision is mandated by Article 302 Labor Code of the Philippines. “An underground mining employee upon reaching the age of fifty (50) years or more, but not beyond sixty (60) years which is hereby declared the compulsory retirement age for underground mine workers, who has served at least five (5) years as underground mine worker, may retire and shall be entitled to all the retirement benefits provided for in this Article.” 02-Jun-26About Nicolas and De Vega Law Offices
