What happens to the means of making infringing materials, such as plates and molds?

In a successful infringement action, the court can order that all plates, molds, matrices, and other means of making infringing marks be delivered up and destroyed. This destruction extends to labels, signs, packages, and any reproductions in the defendant’s possession. Section 157.1 Intellectual Property Code of the Philippines ensures that the tools used to create counterfeits are permanently removed. This prevents the infringer from simply restarting production once the initial stock is seized. “all plates, molds, matrices and other means of making the same, shall be delivered up and destroyed.”   January 7, 2026
