What happens if an application initially lacks one of the filing date elements?

  If an application lacks the necessary elements for a filing date, the IPO gives the applicant a chance to correct deficiencies. Section 41, Intellectual Property Code of the Philippines, provides that the Office examines whether the requirements of Section 40 are satisfied and, if not, the applicant may correct deficiencies under the Regulations. The filing date will then be the date when all required elements are received. If the deficiencies are not remedied within the prescribed period, the application is considered withdrawn. This procedure balances procedural flexibility with the need for timely, complete filings.   21-Dec-25
