What happens if a person kills their spouse with the intention of marrying another?

Committing such a grievous criminal act introduces an insurmountable legal impediment to any future intended marriage. If a person kills their own spouse or the spouse of another to facilitate a marriage, the subsequent union is prohibited. This serious public policy restriction is outlined in Article 38 Family Code of the Philippines. Therefore, the resulting marriage to the intended party is entirely void from the beginning. “9. Between parties where one, with the intention to marry the other, killed that other person’s spouse or his or her own spouse.” 31-Jul-26
