What happens if a corporation or juridical person commits a violation of the Data Privacy Act?

If the guilty offender is a corporation, partnership, or any active juridical person, the corporate structure does not absolve the human actors involved. The explicit law strictly mandates that the severe penalty shall be imposed directly upon the responsible officers who participated in the crime. It also firmly applies to those senior officers who, by their gross and unacceptable negligence, allowed the commission of the privacy crime. Additionally, the designated court has the ultimate power to permanently suspend or revoke any of the juridical person’s operational rights as specified in Section 34 Data Privacy Act. “SEC. 34. Extent of Liability. – If the offender is a corporation, partnership or any juridical person, the penalty shall be imposed upon the responsible officers, as the case may be, who participated in, or by their gross negligence, allowed the commission of the crime. If the offender is a juridical person, the court may suspend or revoke any of its rights under this Act.” 21-May-26
