What constitutes the property right in the “goodwill” of goods or services?
A person who has successfully identified their goods or services in the mind of the public from those of others possesses a property right in the resulting goodwill. This right is protected by law in the same manner as other tangible or intangible property rights. Section 168.1 Intellectual Property Code of the Philippines clarifies that this protection applies regardless of whether a registered mark is used.
