What constitutes the principle of proportionality under the implementing rules?

The principle of proportionality strictly requires that the processing of information shall be completely adequate, relevant, suitable, and necessary. The data actively processed must not be excessive in relation to the specific and declared purpose for which it is being collected. Consequently, personal data shall be collected and processed only if the legitimate purpose of the processing could not reasonably be fulfilled by other means. This core safeguard for limiting data collection is found in Section 18 IRR. “c. Proportionality. The processing of information shall be adequate, relevant, suitable, necessary, and not excessive in relation to a declared and specified purpose. Personal data shall be processed only if the purpose of the processing could not reasonably be fulfilled by other means.” 20-May-26
