What circumstances qualify illegal detention as “serious” and mandate the maximum penalty?

Illegal detention is considered serious if it lasts more than five days, or if it is committed by simulating public authority (Article 267, Revised Penal Code). It is also serious if serious physical injuries are inflicted upon the victim or if threats to kill them are made. The detention is deemed serious if the person kidnapped or detained is a minor, female, or a public officer. The penalty is death where the detention was committed for the purpose of extorting ransom, even without the presence of the other circumstances.
