What authority does a court have regarding the rectification of the trademark register?

  In any action involving a registered mark, the court has the power to determine the overall right to registration. It can order the cancellation of a registration in its entirety or just in part, depending on the case’s findings. Section 161 Intellectual Property Code of the Philippines authorizes the court to rectify the register to accurately reflect the parties’ rights. These judgments are then certified to the Director, who must make the appropriate entries into the Bureau’s records,. “SEC. 161. Authority to Determine Right to Registration. – In any action involving a registered mark, the court may determine the right to registration, order the cancellation of a registration, in whole or in part”   January 7, 2026
