What are the formal requisites of marriage?

Aside from essential requisites, the law also strictly requires formal requisites for a marriage to be valid. The first formal requisite is the explicit authority of the solemnizing officer who conducts the ceremony. The second is a valid marriage license, except in certain exceptional cases specifically provided by law. The third is a marriage ceremony taking place with the personal declaration of the parties, according to Article 3 Family Code of the Philippines,. “Art. 3. The formal requisites of marriage are: (1) Authority of the solemnizing officer; (2) A valid marriage license except in the cases provided for in Chapter 2 of this Title; and (3) A marriage ceremony which takes place with the appearance of the contracting parties before the solemnizing officer and their personal declaration that they take each other as husband and wife in the presence of not less than two witnesses of legal age.” 31-Jul-26
