What are the conditions for government use of a patent during an emergency?

  In situations of national emergency, the patent holder must be notified as soon as reasonably practicable. The scope and duration of the government’s use must be limited to the specific authorized purpose. Use by the government is non-exclusive and requires the payment of adequate remuneration. These conditions for emergency exploitation are listed in Section 74 Intellectual Property Code of the Philippines.   “74.2 Unless otherwise provided herein, the use by the Government… shall be subject… (a) In situations of national emergency… the right holder shall be notified as soon as reasonably practicable;”   January 3, 2026
