May third parties comment on the patentability of an invention after publication?

  Yes, third parties may submit observations on patentability. Section 47, Intellectual Property Code of the Philippines, provides that following publication, any person may present written observations on the patentability of the invention, which are then communicated to the applicant, who may comment. The Office acknowledges these observations and comments and places them in the application file. This mechanism allows public input and may assist examiners in assessing novelty, inventive step, and other requirements.   21-Dec-25
