Is there a limit to reduced statutory damages for innocent infringers?

  When an infringer has no reason to believe they were violating a copyright, damages can be significantly reduced. The court may lower the award to a sum of not more than Ten thousand pesos (Php10,000.00). This reduction recognizes the lack of intent or negligence on the part of the defendant. This limit is found in Section 216.1 Intellectual Property Code of the Philippines.   “…the court in its discretion may reduce the award of statutory damages to a sum of not more than Ten thousand pesos (Php10,000.00)…”   January 8, 2026
