Is an official who has been convicted in an impeachment trial immune from ordinary criminal prosecution?
An official convicted in an impeachment trial does not enjoy immunity from ordinary criminal charges. The party convicted shall nevertheless remain liable and subject to prosecution, trial, and punishment according to standard criminal law. This means they can still be imprisoned or fined by regular courts for the same acts that caused their impeachment. This principle of separate liability is established in Article XI, Section 3, 1987 Philippine Constitution. “…but the party convicted shall nevertheless be liable and subject to prosecution, trial, and punishment according to law.” 06-Mar-26About Nicolas and De Vega Law Offices
