Trademark Renewal in the Philippines
Your trademark maybe renewed for periods of ten (10) years at its expiration upon filing of a request and payment of the prescribed fee. The request may be made within six (6) months before the expiration or within six (6) months after such expiration, subject to the payment of additional fee or surcharge. Non-filing of the request for renewal of registration will result in removal of the mark from the IPO Register. Here are the three (3) simple steps to renew your trademark.
STEP 1
You may file and pay for your application for renewal online at https://ipophil.gov.ph or you may personally file it at the Philippine Intellectual Property Office (IPO) at #28 Upper McKinley Road, McKinley Hill Town Center, Fort Bonifacio, Taguig City. Details required in the request for renewal of trademark registration form are the title of the mark, registration no., date of registration, date of filing of the original application and class nos. Filing fee is P3,131 for 1 class (P6,666 if you are a big entity).
STEP 2
If you receive an Official Action on Renewal from the IPO, you must file a response to it within two (2) months from mailing date. If the IPO has no objections, it will issue a Notice of Issuance. Make sure to pay the fees (P1,484.70 for small entity P2,181.60 for big entity) under the Notice of Issuance within two months from mailing date.
STEP 3
The IPO will issue to you the Renewal Certificate of Registration about 3 to 4 months from date the Notice of Issuance was paid.
That’s how to renew your trademark registration in 3 easy steps. If you do not want the hassle of going through the process, you can appoint a trademark agent to file the renewal of trademark registration for you and receive documents from the IPO on your behalf.
