Members of the judiciary are granted security of tenure to ensure they can adjudicate without fear of arbitrary removal. They shall hold office during good behavior until they reach the age of seventy years or become incapacitated to discharge the duties of their office. However, the Supreme Court en banc retains the disciplinary power to order the dismissal of lower court judges by a majority vote. These provisions regarding tenure and discipline are located in Article VIII Section 11 1987 Philippine Constitution. “SECTION 11. The Members of the Supreme Court and judges of lower courts shall hold office during good behavior until they reached the age of seventy years or become incapacitated to discharge the duties of their office.
