How does the State handle monopolies and combinations in restraint of trade?

The State acts as the primary regulator to maintain a fair and balanced economic environment. It is explicitly empowered to regulate or completely prohibit monopolies when the public interest so requires. Consequently, any business combinations operating in restraint of trade are strictly forbidden. Furthermore, unfair competition in any form is absolutely not allowed under the provisions of Article XII, Section 19, 1987 Philippine Constitution. “The State shall regulate or prohibit monopolies when the public interest so requires. No combinations in restraint of trade or unfair competition shall be allowed.” 22-Mar-26
