How do claims define the scope of a patent in the Philippines?

Claims are central to defining the legal boundaries of a patent. Section 36.1, Intellectual Property Code of the Philippines, provides that the application shall contain one or more claims that define the matter for which protection is sought, and each claim must be clear, concise, and supported by the description. This means that the extent of protection is determined by the wording of the claims, not by the abstract or general description alone. Therefore, precise drafting of claims is critical in determining infringement and validity.   21-Dec-25
