How clear and complete must the disclosure of an invention be in a patent application?
The disclosure must enable a skilled person to carry out the invention. Section 35.1, Intellectual Property Code of the Philippines, requires that the application disclose the invention in a manner sufficiently clear and complete for it to be practiced by a person skilled in the art. For microbiological processes or products involving a micro?organism that cannot be adequately described and is not publicly available, the application must be supplemented by a deposit of the material with an international depository institution.
