How can a patent application be converted into a utility model application?

  An applicant for a patent may convert their filing into a utility model application at any time before the patent is granted or refused. Section 110 Intellectual Property Code of the Philippines allows for this conversion upon payment of a prescribed fee. The converted application retains the original filing date of the initial patent application. However, the law limits this conversion process to occurring only once per application.   “SEC. 110. Conversion of Patent Applications or Applications for Utility Model Registration. – 110.1. At any time before the grant or refusal of a patent, an applicant for a patent may, upon payment of the prescribed fee, convert his application into an application for registration of a utility model, which shall be accorded the filing date of the initial application. An application may be converted only once.”   January 3, 2026
