Does the delivery of presumptive legitimes affect the ultimate successional rights of children?
The early delivery of presumptive legitimes does not prejudice the children’s future inheritance. Their ultimate successional rights remain completely intact and will accrue upon the death of either or both parents. However, the properties already received will be legally considered as direct advances on their final legitime. This protective succession rule is provided under Article 51 Family Code of the Philippines. “The delivery of the presumptive legitimes herein prescribed shall in no way prejudice the ultimate successional rights of the children accruing upon the death of either or both of the parents; but the value of the properties already received under the decree of annulment or absolute nullity shall be considered as advances on their legitime.
